Bombay High Court Clears 60-Foot Road in Everard Nagar

The Bombay High Court ordered BMC to remove remaining shanties and complete Everard Nagar’s 60-foot development-plan road, delayed for about 24 years.

The Bombay High Court ordered the Brihanmumbai Municipal Corporation (BMC) to remove remaining shanties encroaching on land acquired for a 60-foot Development Plan road in Everard Nagar, Sion, and expedite construction. The road had been stalled for about 24 years. A division bench of Justices AS Gadkari and Kamal Khata found L ward assistant municipal commissioner Ajit Kumar Ambi guilty of contempt for failing to comply with demolition orders. The court directed the registrar to summon Ambi to appear on January 27 with his reply on the punishment.

Everard Society’s contempt petition followed a 2015 order giving BMC six months to demolish illegal huts and a public toilet. The society said land acquired around March 2000 for the road had been encroached upon. Five of 52 slum dwellers challenged eviction, claiming BMC had deemed them eligible for rehabilitation. The society had surrendered a 30-foot strip for the proposed road. BMC did not act on complaints or respond for nearly 11 months to a 2016 RTI request about compliance.
