The Bombay High Court ruled on September 29 that CIDCO cannot demand transfer charges from Manmandir Cooperative Housing Society in Nerul and Surya Cooperative Housing Society in Vashi, whose land leases predate February 8, 1990, and contain no transfer-charge requirement. The ruling does not automatically cover the Navi Mumbai Cooperative Housing Federation’s other 2,528 member societies; their eligibility depends on their individual lease deeds.
The case followed CIDCO’s October 26, 2016 demand for ₹24.58 lakh from Manmandir CHS for transfers of 27 flats. The federation and societies challenged the 1990 amendment to the New Bombay Disposal of Lands Regulations, 1975, which introduced approval and transfer-charge requirements. CIDCO argued the charges regulated transfers and the amendment clarified existing rules. Justices Bharati Dangre and Manjusha Deshpande held it was a substantive change and could not retrospectively create a financial liability absent from the original leases.
