The Maharashtra State Board of Waqfs cancelled the separate registration of Baner Masjid by order dated September 2, 2026, and declared all permissions and property transactions void ab initio. The property comprises 7 hectares 34 ares (approximately 18 acres) at Survey No. 99/1 in Baner, associated with Hazrat Udan Shah Wali Dargah and Baner Masjid. The Board held that the separate Baner Masjid registration (MSBW/PUN/4872) was not legally valid.

The property traces to a grant by the then Governor of Bombay via Order No. 986 dated August 12, 1870, and was registered as Udanshah Wali Dargah Trust (Public Trust No. B-382) with the Charity Commissioner.

A 2006 sale permission for ₹9.51 crore was issued on September 29, 2006, with ₹7 crore to go to the Waqf Board. A separate No-Objection Certificate was issued on November 3, 2006. The sale deed was executed on October 31, 2009. Applicants challenged the authority to issue the NOC and questioned whether Board approval, public auction, and proper valuation were obtained.

The Board found the then-CEO lacked legal authority to issue the November 3, 2006 NOC. Purchasers argued the Board could not reopen its decision after several years and claimed to be bona fide purchasers; these objections were rejected.

The Board directed the Pune district administration, revenue authorities, and registration officials to recognise Hazrat Udan Shah Wali Dargah as the relevant Waqf institution, cancel revenue entries and sale deeds arising from voided transactions, and make corresponding changes in revenue and registration records. A May 27, 2025 communication from the then-CEO regarding the property was also revoked.

PMC carried out encroachment drive on Tuesday along Aundh-Baner link road from Medipoint Chowk to Vidhate Vasti Chowk and main Baner Road. 35 notices served before action. Over 31,200 square feet of encroached land cleared, targeting unauthorised shops, hotels, tin sheds and permanent concrete structures built without civic approval. One JCB, gas cutter and ten-member encroachment staff deployed with police security. Cleared area will be used for public utility and road expansion to improve traffic flow. PMC officials stated similar operations will be intensified across other parts of the city. Drive conducted under supervision of Zone 3 Superintending Engineer and Executive Engineer.

Bombay High Court bench headed by Chief Justice Alok Aradhe and Justice MS Karnik ordered district magistrate and special land acquisition officer to complete land acquisition for Baner-Pashan Link Road within two months and PMC to complete construction within four months from taking possession.

The road, sanctioned in 1992 Development Plan, spans 1,200 metres and is 36 metres wide. Of this, 1,000 metres were constructed in 2014; two patches measuring 150 and 50 metres remain incomplete, leaving 200 metres unfinished and road largely unusable.

Advocate Satya Muley representing Baner-Pashan Link Road Welfare Trust argued PMC repeatedly failed to act on prior HC directions since PIL filed in 2021. July 10 order instructed PMC to expedite remaining 200 metres; this was not done.

August 2, 2023 bench led by Chief Justice Devendra Kumar Upadhyaya remarked leaving 200 metres incomplete is against public interest and renders 1,000 metres expenditure wasteful.

Incomplete infrastructure affects over 2.5 lakh residents in Baner, Pashan, Balewadi, Aundh and adjoining areas. Region witnessed significant population growth over past 15 years with citizens facing severe hardships.

Rajendra Chuttar, president of Baner-Pashan Link Road Welfare Trust, said residents sought justice for roads, amenities, and water supply.

Residents living on and near Baner-Pashan Link Road (BPLR) have expressed concerns about the worsening state of the stretch and the entire neighbourhood.
