Westend Green Farms Society, a premium farmhouse community established in 1993 and registered with the Registrar of Societies, holds a valid trademark registration for "Westend Greens" in Class 45 (word and device marks). The Society approached the Supreme Court against a Delhi High Court judgment dated December 17, 2025, which upheld the trial court's rejection of its trademark infringement suits under Order VII Rule 11 CPC on grounds of lack of cause of action.

The dispute began in 2021 when certain individuals allegedly began using the "Westend Green" name despite being residents of a separate society, Amaltas Avenue. The Society claims such unauthorised use infringes its registered trademark and constitutes passing off, potentially misleading the public and damaging its reputation.

A Supreme Court Bench comprising Justice J.B. Pardiwala and Justice Vijay Bishnoi issued notice on April 20, 2026, and directed the matter be tagged with connected petitions. A related petition heard by Justice J.B. Pardiwala and Justice K.V. Viswanathan on April 6, 2026, also issued notice and ordered tagging with another connected Special Leave Petition.

The Society's counsel argued that both trial court and High Court erred in rejecting suits at the preliminary stage, contending the plaints disclose a cause of action requiring detailed examination during trial rather than summary dismissal. The Supreme Court will examine the legality of the impugned orders and the scope of Order VII Rule 11 CPC in intellectual property disputes.

Delhi High Court disposed of contempt petition filed by Westend Green Farms Society against Delhi Jal Board (DJB) for non-compliance with court orders dated October 15, 2025, and December 4, 2025, directing water supply. DJB agreed to supply water subject to payment of requisite charges. Society comprises approximately 170 high-end farmhouses in Rajokri and Rangpuri areas of Vasant Kunj. Residents pay substantial property tax running into crores annually. Court recorded DJB's undertaking to ensure water supply on immediate basis.
