Karnataka high court upheld BDA's acquisition of land at Gubbalala village for Banashankari VI Stage extension linked via Kanakapura Road.

Bangalore Development Authority (BDA) sought to acquire land at Gubbalala village for formation of further extension of Banashankari VI Stage by linking the existing VI Stage Layout through Kanakapura-Bengaluru Main Road. Preliminary notification issued Nov 7, 2002, for 1,532 acres and 17 guntas across eight villages. Final notification issued Sept 9, 2003, reduced to 750 acres including 142 acres and one gunta at Gubbalala village. Acquisition subsequently restricted to 395 acres and 37 guntas, including 39 acres and 10 guntas of Gubbalala village. Landowners challenged notifications; single bench on Jan 27, 2025, quashed acquisition of approximately three and a half acres belonging to petitioners on ground BDA had not taken possession.

A division bench of Justice DK Singh and Justice Tara Vitasta Ganju dismissed appeals by K Gangamma and others against a single bench order that dismissed petitions challenging acquisition of 75 guntas in Gubbalala village. Land was first notified Nov 17, 2002; final notification issued Sep 9, 2003. Appellants claimed they were not given same benefit as landowners of 657 acres and 15 guntas whose land was left out of acquisition on payment of betterment charges. Appellants also claimed scheme was not implemented within scheduled five years and should be treated as lapsed with land resumed. Single bench dismissed petitions April 8, 2024; appellants appealed to division bench with same contentions.
