Maharashtra’s Urban Development Department plans to roll out an occupation-certificate (OC) policy from October 2 for more than 25,000 Mumbai buildings constructed under the development regulations of the BMC, MHADA, SRA and other authorities. It will address technical or administrative construction lapses and issues including differences in sanctioned floor area and setback hurdles.

Willingdon Heights in Tardeo may get its approximately ₹35 crore penalty reassessed under DCR 1991 rather than later regulations. The amount included parking charges. Residents said the building was constructed under DCR 1991, had recently received a provisional Mumbai Fire Brigade NOC, and its OC was being processed; they said free floor-space-index usage charges and a six-month penalty would be waived. BMC Chief Engineer Sunil Rathod said relief would depend on the state government’s decision and applicable clauses.

The top 17 floors were vacated, and 27 families left the flats on August 28. Guardian Minister Ashish Shelar announced the policy. Residents said they were seeking compliance with Bombay High Court directions to obtain an OC and return home.

Residents of the 34-storey Willingdon Heights Cooperative Housing Society in Tardeo have applied for an Occupancy Certificate after complying with fire-safety requirements. Municipal commissioner Bhushan Gagrani said the residents were supposed to pay a ₹32 crore penalty and had reluctantly agreed; the BMC would inform the High Court after payment. Society chairman Narendra Bhandari said that, as of Thursday, 4 September 2025, the BMC had given them no written figure, although its architect had indicated roughly that amount. Gagrani did not respond when asked about Bhandari’s statement. A High Court hearing scheduled for 4 September at 2:45 pm before a Division Bench of Justices GS Kulkarni and Arif S Doctor was cancelled. Residents remain in makeshift homes at offices, hotels or relatives’ homes.

Twenty-nine families moved out of floors 17–34 of the 34-storey Willingdon View CHS in Tardeo on August 28, after the Bombay High Court’s August 27 deadline. The August 3 order required residents to vacate because those floors lack an occupancy certificate (OC); the building has an OC only for its first 16 floors and lacks a fire department no-objection certificate. The court had granted a three-week extension on humanitarian grounds. The BMC plans a surprise inspection to verify the flats are vacant; residents say they have locked them. Cabinet minister Mangal Prabhat Lodha said Chief Minister Devendra Fadnavis directed the BMC to issue the long-pending full OC, saying residents were deceived by builder M/s Satellite Holdings. Residents allege the builder used fake layout plans and ignored legal and safety requirements. The next court hearing is September 2. Residents say families have relocated, including to Nashik, Dhule and Rajasthan, and allege they face double property-tax, water and utility charges without a full OC.

Twenty-seven families living on floors 17–34 of Willingdon View Cooperative Housing Society in Tardeo face eviction on August 27 unless they obtain a fire No Objection Certificate (NOC). The building, constructed in 2010, has only a partial Occupancy Certificate (OC) and no fire NOC. The Supreme Court declined on August 1 to interfere with the Bombay High Court’s eviction directive; the society undertook to vacate to the BMC on August 8. Failure to leave could lead to police-assisted eviction and sealing. A High Court hearing on August 22 concerns the OC for floors 1–16, where 25 families live and are currently protected by the partial OC.

Residents are working to meet 17 Mumbai Fire Brigade requirements, including sprinklers on every floor, diesel generator sets and a nine-metre-wide emergency ramp. The fire department inspected the building. The BMC first issued a vacate notice in 2018 under the MRTP Act and reaffirmed it in February 2025. Around 80% of Mumbai buildings reportedly operate with partial OCs, which a housing expert said builders can use to obtain permission for interior work.
