Oberor Woods society filed complaint in 2014 citing issues affecting over 400 flats: severe leakage problems in flats and common areas, inadequate parking spaces, undelivered amenities including recreation ground, swimming pool, clubhouse, and quality construction standards. Residents received flat possession in 2008; leakage issues have persisted despite repeated complaints and temporary repairs.
Oberol Realty argued complaint was barred by limitation (filed six years after 2008 possession). Developer claimed maintenance of common areas was handed to society in September 2009 with corpus fund, shifting responsibility. Oberoi Realty also claimed society had not cleared outstanding dues required under agreement to finalize conveyance.
Society contended that while residents hold physical possession, developer retains title. Under Section 11 of Maharashtra Ownership Flats Act (MOFA), developer was obligated to transfer title unconditionally within four months of registration. Oberoi Realty proposed 99-year lease with specific access rights for Oberoi Foundation, which society rejected.
Oberol Realty dismissed architect Shrikant Hadke's report highlighting structural deficiencies, claiming it exceeded scope and was rejected by other judicial bodies. Commission noted structural deficiencies were evident but alterations by residents over time could have contributed to damages and leakages, not builder's lifelong responsibility.
