Bombay High Court ordered deemed conveyance certificate for 740 flats in Neelkanth Heights, Thane, after residents' two-decade struggle against developer Abhinav Real Estate.

Bombay High Court ordered issuance of deemed conveyance certificate for Neelkanth Heights Cooperative Housing Societies Association Ltd in Thane, benefiting over 700 flat owners. Court directed Competent Authority to issue conveyance certificate under Section 11(3) Maharashtra Ownership Flats Act (MOFA). Developer Abhinav Real Estate Private Limited (now Neelkanth Realtor Private Limited) had delayed property transfer for nearly two decades despite MOFA requirement of conveyance within four months of society formation.
Association comprises three registered societies: Rameshwar (2004), Mansarovar (2005), and Girija (2011). Total 740 flats and 29 shops built at Majiwada, Thane. Justice Amit Borkar (April 24 judgment) found developer's resistance violated flat purchasers' statutory rights. Competent Authority had rejected application citing phased development, status quo order in civil suit, and claims of excess land sought. Court rejected these objections as baseless, noting no construction for years and calling developer's arguments speculative. Court upheld legality of Apex Society formation, ruling individual registered societies entitled to join umbrella association without builder consent. Court accepted Association's architect's calculations for land area and rejected builder's claim of excess land sought. Order does not affect any civil claims developer may pursue separately.
