TGRERA orders Nebula Aavaas to drop prior allottee penalties, register flats

TGRERA directed promoter Pacifica Constructions (Nebula Aavaas Hyderabad) at Bachupally to exclude late payment charges attributable to prior allottees when recalculating dues for current buyers and to proceed with flat registration upon clearance of legitimate amounts.
Complaints from multiple allottees alleged promoter levied late fees partly covering periods before their allotments (December 15, 2018) and not disclosed at re-allotment or reflected in Agreements for Sale (January 18, 2019). Promoter argued complainants "stepped into shoes" of earlier allottees and were liable for accumulated dues; project was complete and registration would follow payment.
Authority found no documentary proof of prior allotments or contractual clause making complainants liable for earlier defaults. Liability for late charges must arise from express contractual obligation or allottee's own defaults.
Directions: Promoter must rework Statement of Accounts excluding late charges attributable to prior allottees, compute charges only for defaults after allotment per Agreement for Sale, furnish clear itemised revised Statement, and execute and register sale deeds and hand over possession upon payment of legitimate dues.
On maintenance charges: Increase from ₹1.25 per sq ft to ₹3.6 per sq ft upheld due to six-year gap since 2019 agreement and inflation, but promoter directed to convene Association of Allottees General Meeting within 30 days to place maintenance requirements and reach consensus on future charges.
On GST: Authority held rate determination and excess collection determination falls exclusively within GST authorities' jurisdiction; directed complainants to approach competent tax authority.
Identical directions issued in separate complaints by other allottees. Failure to comply will attract penal action under Section 63 of Real Estate Act, 2016.

Nebula Aavaas was fined ₹2 lakh by Telangana Real Estate Regulatory Authority (TGRERA) after complaint by Ramakrishna Rampally, who booked a flat in Nebula Aavaas's under-construction project by Aavaas Hyderabad. Ramakrishna paid ₹8,06,875 in instalments between December 2016 and July 2020, then discontinued due to difficulties securing a home loan, leading to booking cancellation in January 2021. Despite multiple refund requests, he received only ₹5,67,656 after 18-month delay, leaving a shortfall of ₹2,39,219. The builder claimed several of Ramakrishna's cheques were dishonoured.
