NCLT admits Supertech ORB to insolvency process

The National Company Law Tribunal admitted Supertech ORB project to corporate insolvency resolution on October 13 after the company defaulted on Rs. 482 crore debt.

Key facts

The NCLT at Prayagraj admitted Supertech ORB to insolvency resolution process on October 13, 2023. Assets Care and Reconstruction Enterprises Limited (ACRE) filed the plea citing default on Rs. 482 crore debt including principal and interest. Shailendra Ajmera, resolution professional of Go First, was appointed as interim resolution professional for Supertech ORB.

ACRE had acquired loans from Altico Capital Ltd, which sanctioned Rs. 349 crore to Supertech ORB in 2017. The company defaulted on scheduled repayments, leading ACRE to issue acceleration and enforcement notice in September 2022. The parties settled with agreement that units of Project Cape Town would transfer to ACRE by December 2021, but Supertech ORB failed to do so and the agreement was terminated in April 2022.

Supertech ORB contested that ACRE was not revealing full facts and claimed ongoing second settlement talks. The tribunal found the debt was not disputed and default was clear, admitting the company to Corporate Insolvency Resolution Process (CIRP).

In 2022, Supertech Limited was admitted to CIRP by NCLT Delhi. NCLAT later modified the order exempting all projects except Eco Village II. Supreme Court approved this in May 2023.

Government is reportedly considering amendments to Insolvency and Bankruptcy Code 2016 to enable project-wise resolution of real estate companies.
