Chandigarh may allow share-wise property registration in non-heritage sectors

The UT administration is considering allowing share-wise property registration in Chandigarh's Phase 2 and Phase 3 sectors while maintaining restrictions in heritage sectors following a 2023 Supreme Court order.
Key facts
UT administrator Gulab Chand Kataria directed officials to explore solutions after share-wise registrations remained suspended for nearly three years following a January 10, 2023 Supreme Court order barring conversion of residential houses into floor-wise apartments in heritage sectors (1-30).
The court directed the Heritage Committee to examine re-densification in heritage sectors. The UT administration then imposed a blanket ban on share transfers outside the family across Chandigarh and halted approval of building plans for jointly owned properties by unrelated individuals.
The administration is now reviewing legal aspects to determine whether registrations can resume in Phase 2 (Sectors 31-47) and Phase 3 (beyond Sector 47) without violating court directions, as officials believe restrictions primarily relate to Phase 1 sectors.
Before the suspension, 80-100 share-wise registrations occurred monthly (1,000 annually), generating approximately 5% stamp duty. Revenue losses are estimated at over ₹40 crore. No such restrictions exist in neighbouring Panchkula and Mohali.
Chandigarh MP Manish Tewari has raised the issue repeatedly in Lok Sabha, arguing the SC order did not explicitly prohibit share-based property sales. Property dealers' associations and Vikram Chopra, president of the Property Consultant Association Chandigarh, have demanded resumption of registrations. The Ministry of Home Affairs sought a report from the UT administration on the issue.
