The court held that flat purchasers relied on statutory approvals and cannot be punished for alleged illegalities by the developer and municipal officials.
NMMC had already issued a provisional Occupation Certificate after collecting more than ₹101 crore in penalties.
Residents had been suffering for years because the final OC has not been issued; the developer has not obtained the OC since 2012.
Since March 2021, owners had been barred from selling or transferring homes under interim orders; the court vacated those restraints.
The court said there is no legal bar on transferring flats merely because the final OC is still pending.
It noted the petitioner had selectively targeted Palm Beach Residency and the case had become a private dispute.
The bench said NMMC has identified more than 2,100 buildings built without required permissions or in violation of sanctioned plans.
The ruling does not endorse any illegality by the developer or civic officials; the state government and NMMC may proceed against erring parties under law.

Navi Mumbai’s Palm Beach Residency in Nerul received a provisional occupancy certificate after 13 years, following court directions and heavy penalty payments.

Amey Cooperative Housing Society Limited’s Palm Beach Residency in Nerul, Navi Mumbai, got a provisional occupancy certificate from NMMC 13 years after construction.
The complex faced litigation over construction violations of more than 3 lakh sq ft.
The OC came after payments totalling about ₹100 crore: ₹66.67 crore to NMMC and around ₹34 crore to CIDCO for permissions.
The project was earlier linked to allegations of illegal land allotment by CIDCO to six ‘bogus’ cooperative societies of APMC mathadis, later merged and sold to the Wadhwa group.
The Supreme Court cleared the project, and it was completed in 2012.
NMMC refused to issue an OC after FSI violations were reported.
In 2018, activist Sandeep Thakur filed a PIL in the Bombay High Court; the society also filed a writ petition seeking permissions.
In October 2024, the High Court allowed NMMC to decide on regularisation.
On December 31, 2024, NMMC agreed to grant an OC subject to payment of penalty, additional premium and other conditions.
On March 4, the court allowed deposit of the amount to NMMC and directed issuance of a provisional OC subject to further orders.
NMMC said the new Unified Development Control and Promotion Regulations, which allow additional FSI, helped regularise the building.
The provisional OC remains subject to previous court rulings, including a bar on sale or purchase of units, and confirmation of the consent to operate from MPCB.
The society lacks environmental clearances; issues involving permissions from MCZMA and SEIAA are due to be heard next on July 8.
