NCLT dismisses insolvency petition against Mahagun after settlement

National Company Law Tribunal dismissed insolvency proceedings against Mahagun after the developer and IDBI Trusteeship signed a settlement agreement on February 12.

NCLT dismissed as withdrawn an insolvency petition filed by IDBI Trusteeship Services Ltd against Mahagun real estate firm after the parties signed a settlement agreement on Feb 12, 2026.

IDBI Trusteeship filed the insolvency application on Aug 5, 2025, which was admitted by the tribunal. The order was challenged before NCLAT, which on Nov 6 set aside the admission order and remanded the matter for fresh consideration.

On Feb 17, 2026, the NCLT bench comprising technical member Reena Sinha Puri and judicial member Bachu Venkat Balaram Das dismissed the insolvency petition as withdrawn. The bench noted the parties had entered into a settlement agreement dated Feb 12, 2026, and the financial creditor sought withdrawal of proceedings. All pending applications in the matter were disposed of. The financial creditor retained liberty to revive the petition in case of non-adherence to settlement terms.
