Emerging Valley Director Jailed for Defying Mohali Flat Order

A consumer commission sentenced Emerging Valley director Gurpreet Singh Sidhu to three years in prison for failing to deliver a Mohali flat or refund the buyer.

The District Consumer Disputes Redressal Commission sentenced Gurpreet Singh Sidhu, director of Emerging Valley Private Limited, to three years’ rigorous imprisonment and fined him ₹1 lakh under Section 72 of the Consumer Protection Act, 2019. The commission directed ₹50,000 of the fine to the complainant’s legal heirs and the remainder to the state exchequer.
The case concerns a flat in Emerging Valley’s project at Sector 115, Sante Majra, Kharar-Landran Road, Mohali (Banur area). On October 4, 2023, the commission ordered the builder to deliver the completed flat with a completion certificate within two months, or refund ₹20.49 lakh with 9% interest, rising to 12% on default, plus ₹50,000 compensation and litigation expenses.
The builder did not comply. A court-appointed advocate reported that the offered flat was unfit for occupation. The commission rejected Sidhu’s financial-difficulty claims and ordered him, already in custody, to serve his sentence at Model Jail, Chandigarh.
