Bombay High Court Protects Ekta Meadows Residents in Parking Dispute

The Bombay High Court barred authorities from acting on a police warning against parking at Ekta Meadows until June 15.

The Bombay High Court granted interim relief until June 15 to residents of Ekta Meadows Cooperative Housing Society, Borivali East, and directed authorities not to act on a May 19 police communication warning against unauthorised parking on a proposed Development Plan road.

A vacation bench of Justices Shyam Chandak and Shreeram Shirsat heard the society’s petition against the Dahisar Transport Department Senior Police Inspector’s communication, which cited possible obstruction of emergency services. The society said residents of Wings A to G at Khatao Estate had parked within its premises for years under the approved layout and sanctioned plans, without blocking public movement or emergency access.

Built in 2007-08, the society was handed an internal private access road; its occupation certificate and sanctioned plan specify a 12-metre-wide road. It said it learned in August 2018 that authorities were considering converting the road to public use, and received no satisfactory response to letters. It challenged the police communication for being issued without a hearing or reasoned order. The society assured the court residents would not obstruct emergency services.
