Court halts industrial plot auction at IMT Bawal Rewari

Punjab and Haryana high court barred HSIIDC from auctioning an industrial plot in IMT Bawal after rejecting the highest bidder's bid.
Key facts
Richaco Exports Pvt. Ltd. filed a writ petition challenging HSIIDC's rejection of its highest bid for an industrial plot in Sector-8, IMT Bawal, Rewari. The plot measures 13,300 square metres with an initial reserve price of ₹16,300 per square metre. Richaco Exports deposited ₹1,08,64,500 as 5% earnest money deposit on August 16, 2024. In the e-auction held November 5, 2024, Richaco Exports made the highest bid at ₹19,300 per square metre, which HSIIDC accepted. However, on December 2, 2024, HSIIDC rejected the bid citing two reasons: less than 5 applications received, and less than expected price received. The petitioner's advocate argued the rejection was wrongful and arbitrary, noting HSIIDC knew about fewer than 5 applications before conducting the auction and that the expected price concern was invalid since HSIIDC re-advertised at the same reserve price. The Punjab and Haryana high court bench (Justices Sureshwar Thakur and Vikas Suri) on February 25, 2025, directed HSIIDC to maintain status quo of the plot.
