Division bench of Chief Justice Gurmeet Singh Sandhawalia and Justice Jiya Lal Bhardwaj said forest department had "failed miserably" in protecting green cover. Forest department report showed 155 trees felled primarily by three builders—SSRN Infracon LLP, Barog Resorts, MMM Infra Private Limited—over area of 50,058 square metres. Builders justified felling on grounds trees were on private land, not forest land. Court directed state to submit fresh report and warned failure could lead to examination by independent agencies such as CBI. Court noted Himachal Pradesh Land Preservation Act, 1978, also applies restrictions.
