Noida Residents Question CAM Payments Amid Service Disputes

Residents of two Noida-area housing societies are protesting CAM charges and service problems, while legal experts say dissatisfaction alone does not permit withholding payments.

A 40% increase in CAM charges at Noida’s Cleo County triggered protests. Residents of Ajnara Homes in Greater Noida West are protesting alleged restrictions on entry for delivery personnel and workers, and deficiencies in garbage collection, lifts, fire safety and the sewage treatment plant (STP). Around 2,200 people live in the society; resident Dinkar Pandey said about 1,000 joined the protest. Residents also alleged rainwater accumulated in the basement. Garbage collection was disrupted for around four days; Greater Noida Authority officials visited on September 26, after which door-to-door collection resumed and management was directed to improve cleanliness.
No clear guidelines or mandatory audit mechanism currently govern CAM charges, said Abhishek Kumar of NEFOWA. Experts said payment obligations depend on agreements, state laws, RERA provisions and transfer of maintenance responsibilities. Advocate Amitraj Kaushal said residents cannot unilaterally withhold charges over service dissatisfaction; they can complain formally to the builder or RWA and approach RERA or a consumer forum. Non-payment may incur interest or penalties, restrictions on some common amenities, or recovery proceedings. Water and electricity generally cannot be cut off arbitrarily.
