The CCI dropped a buyer’s anti-profiteering case over a Swastik Heights flat in Ahmedabad, finding the developer was not required to reduce its price further.
Key facts
Jainil Jayeshbhai Mehta alleged that Swastik Harmony Developers failed to pass on GST-rate reduction and input tax credit (ITC) benefits for Flat 601 in its Swastik Heights project in Ahmedabad. He booked the flat on 28 February 2019 at a base price of ₹25 lakh, with GST charged at 8%; the developer had promised to pass on ITC benefits.
The DGAP’s report, dated 10 August 2023, found the project began after GST implementation, leaving no pre-GST turnover or ITC for comparison. The developer charged 8% GST with ITC rather than the 1% rate without ITC available from 1 April 2019, a permitted option. The CCI found Section 171(1) of the CGST Act did not apply, dropped the proceedings and ordered no action against the developer.
