Delhi High Court Presses Centre for Sainik Farm Regularisation Decision

The Delhi High Court urged the Centre and other authorities to decide Sainik Farm’s regularisation and create a mechanism allowing residents to make repairs.

The Delhi High Court directed the Centre and other Delhi authorities to make a collective, final decision on regularising Sainik Farm, saying residents whose homes were built nearly five decades ago remain unable to carry out basic repairs. The court was hearing a 2015 petition by Ramesh Dugar, of the Sainik Farm and Defence Services Enclave Residents Welfare Association, alleging discriminatory exclusion from regularisation policies. It suggested legislation or another legally permissible mechanism for repairs and minor alterations.

The Centre’s 2019 notification regularised 1,797 unauthorised colonies, granting ownership rights, construction permissions and loan eligibility, but excluded 69 affluent colonies, including Sainik Farm and colonies on forest land. The 2006 K.K. Mathur Committee classified areas as affluent when more than 50% of plots exceeded 350 sq m. PM Uday also excludes affluent unauthorised colonies. The court had intervened in April 2022, May 2023 and February 2025. The next hearing is October 8.
