Legal Action Against Real Estate Company Directors
Following complaints by a group of home buyers, the chief judicial magistrate has ordered the booking of the directors of Gayatri Hospitality and Realcon Limited, a real estate company in Noida, for fraud, forgery, and cheating.
Project Delays and Complaints
The buyers alleged that in 2011, the company launched a project named Gayatri Aura in Noida, but construction has not commenced, with not even basic groundwork initiated.
B P Singh Jadon, a lawyer representing one of the buyers, Sunit Awasthi, stated that the company was to construct 1,500 homes in Sector 1 of Noida Extension. 17.5 acres of land were allocated to the company for this project. Awasthi booked a 1,195 square feet flat in Gayatri Aura in 2011 and paid Rs 16 lakh. However, despite repeated meetings and assurances from the builders, construction has not begun.
Registration of Case
On July 2, the case against the company was officially registered. Awasthi claimed that nearly 1,000 residential units had been sold by the builder, with many families having invested significant amounts. Payments ranging from 30% to 90% have been made by these individuals, but no construction has been initiated, not even the groundwork has been laid.
Alok Jain, another investor in Gayatri Aura, remarked that on July 2, the chief judicial magistrate of Gautam Budh Nagar ordered the police to lodge an FIR under the applicable IPC sections. He added that many other complaints against the builders are pending with the CJM.
FIR Details
An FIR has been lodged at the Noida Phase-III police station under sections 420, 467, 406, 471, 468, 504, and 120B of the IPC against two directors of Gayatri Hospitality and Realcon Limited, Hari Om Dixit and Kalyani Chaturvedi. The police station SHO Pankaj Pant confirmed that an investigation officer has been appointed.
GNIDA’s Response
Deepak Agarwal, CEO of GNIDA (Greater Noida Industrial Development Authority), stated that they were unaware of the developer’s actions. If the builder has violated any norms, appropriate action should be taken. Agarwal affirmed, "Our aim is to protect the interests of home buyers, and we will continue to do so."
