Rejection of Supertech Projects
The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has rejected the application for registration of two proposed Supertech projects. This decision was made under RERA Section 5, along with Section 11(4)(B) and Section 4(2)(B).
Affected Projects
The projects in question are Supertech Golf Country GH01-Phase-1B and Supertech Golf Country GH01-Phase-1A.
Reasons for Rejection
The rejection was due to the developer’s failure to complete a significant number of its projects within the specified timeline, as well as its non-compliance with several orders from the authorities relating to home buyer complaints.
UP-RERA's Requirements
The authorities requested a comprehensive report on the developer’s compliance with its previous orders and a convincing action plan for completing its projects. However, UP-RERA decided to offer the developer a second chance to reapply for the registration of the two projects once it has largely complied with the authority’s previous directives.
Hearing Outcome
During the trial, R.K. Arora, Chairman of Supertech, informed the authorities that the company was working towards completing the projects and enforcing government orders. However, UP-RERA found the promoter’s written and oral responses unsatisfactory. They concluded that registering the company’s two new projects would be disadvantageous and not in the best interests of home buyers.
Chairman's Statement
UP-RERA Chairman, Rajiv Kumar, stated: 'The developer did not comply with the authorities’ orders and there was no noticeable improvement in the status of unfinished orders. They also failed to come up with a convincing action plan to implement their ongoing projects. As a result, a large number of home buyers with the developer were forced to approach the authorities with claims for compensation. Not only did the developer fail to speed up its projects, it also did not comply with government orders, further exacerbating the home buyer’s suffering.'
