SC refuses to pass order allowing Subrata Roy to go abroad

New Delhi: The Supreme Court of India has refused to issue any interim ruling that would allow Sahara Chief Subrata Roy to exit the country. This decision comes in response to a review petition aimed at altering the court’s previous order, which had imposed restrictions on his international travel.

A panel consisting of Justices KS Radhakrishnan and AK Sikri remarked that they cannot pass any directive until the group formally submits a request to review the plea, should it wish to seek any changes. This situation arose when the Sahara Counsel presented the matter before them.

During the proceedings, senior advocate CA Sundaram argued that the group is not requesting a re-evaluation of the previous order but merely wishes to clarify discrepancies between the version of the decision available on the apex court's website and the official order issued by the court itself. However, the Bench expressed its dissatisfaction with the arguments presented.

The Sahara Group had approached the Supreme Court arguing that the restriction on Roy’s travel stems from a misunderstanding related to the requirement of depositing documents with the Securities and Exchange Board of India (Sebi).

The group’s legal representative asserted that Subrata Roy would only be barred from leaving the country if the necessary documents are not submitted to Sebi within the designated timeframe.
