The National Consumer Dispute Redressal Commission (NCDRC) has offered significant relief to flat owners in Noida Extension by staying the cancellation of their properties. Over 100 flats, which were allegedly cancelled by a developer, will remain unaffected pending further orders as per the commission's ruling.
The worries of those prospective flat owners arose last month when, after the approval of the Greater Noida Master Plan 2021 by the planning board of the NCR, a developer abruptly cancelled their bookings. Following this distressing turn of events, the construction activities in the area resumed, amplifying the concerns of buyers who found themselves in a precarious situation.
In response to these cancellations, distressed homebuyers from Noida Extension approached the NCDRC last month, seeking intervention in the troubling situation caused by the private developer's actions.
During a hearing for the petition filed by the Noida Extension Flat Owners Welfare Association—representing the interests of the buyers—the commission issued a notice to the developer, effectively placing a stay on the cancellations until further notice. This decision has halted the cancellation of more than 100 flats, providing a glimmer of hope for the affected buyers.
Mr. Abhishek Kumar, a representative of the Noida Extension flat owners’ association, described the commission's order as ‘rays of hope’. He noted that this development would pave the way for further legal actions aimed at ensuring accountability and adherence to regulations in the sector.
The flat buyers have voiced allegations against the builders of harassment and have expressed their intent to hold a protest meeting this Sunday at Noida Extension, sometimes referred to as Greater Noida West.
With the approval of the Master Plan 2021, builders have been increasing property prices, leading to additional tensions as buyers have reported threats from developers regarding payment demands.
In light of these challenges, many buyers have sought assistance from various authorities, including the Union Urban Development Ministry, the Competition Commission of India (CCI), and the Greater Noida Authority. Complaints were even lodged with CREDAI, seeking to resolve issues pertaining to their bookings and the ensuing cancellations. Thankfully, with the NCDRC’s ruling, temporary justice has been served, alleviating some of the buyers' immediate concerns.
