Property Cards for MahaRERA-Registered Apartments on the Horizon

A senior tax official revealed that Maharashtra is embarking on an initiative to provide property cards to apartment owners in projects registered with MahaRERA. This comes after the state cabinet's 2019 approval of a scheme to issue individual property cards for apartments, sometimes referred to as vertical objects. These property cards are intended to furnish apartment owners with comprehensive information, including details regarding carpet areas, utility rooms, loan information, and the crucial 7/12 extract (Utara) of their respective land parcels.

Addressing Objections and Ensuring Smooth Implementation

The ambitious project encountered several proposals and objections, prompting the establishment of a dedicated commission. The commission is tasked with submitting recommendations to the state government before the project's official launch. The primary objective is to meticulously map the vertical growth witnessed in both urban and rural areas while simultaneously maintaining an independent rights register. This register will meticulously document flats and individual apartment units.

“The Committee on Vertical Property Cards presented its recommendations to the government and proposed a gradual implementation of the scheme. Discussions are underway with the Maharashtra Property Regulatory Authority (MahaRERA). The final decision will be made by the government,” the official stated.

Bridging the Ownership Gap for Apartment Dwellers

While the state currently issues property cards for urban areas and 7/11 declarations for rural areas, clearly defining property rights, a critical gap exists for apartment owners. There's currently no official document that definitively confirms the ownership of individuals residing in apartments within larger buildings.

To address this, the Ministry of Revenue is adapting the Maharashtra Land Revenue Code, the Property Register, and Apartment Registration and Building Codes within the existing framework of the Maharashtra Land Revenue Code of 1966. This adaptation empowers the state to formally issue property cards for apartments in the state of Maharashtra. Although Maharashtra possesses around 56 lakh property cards for plots and an extensive 2.5 crore 7/12 extracts, the official highlighted a crucial missing piece: “But there is no evidence that vertical buildings such as apartments or commercial complexes were built on these lands.”
