HUDA Dismisses Extra Fee for Alternative Plots
Gurgaon: The Haryana Urban Development Authority (HUDA) has reversed its decision to charge extra fees from individuals who were allotted alternative plots instead of their original ones.
The Haryana authority had initially sent notices requesting the additional fee but subsequently withdrew all such notices.
Background
A client from Gurgaon was initially allotted a plot in Sector 28. However, due to a dispute involving the plot, HUDA offered him an alternative plot in Sector 38 and demanded an extra amount for this new plot.
Legal Action
After paying the enhancement fee, the plot owner approached the Punjab and Haryana High Court, challenging HUDA’s notice.
High Court Verdict
The High Court ruled in favor of the plot owner, declaring, "The petitioner is likely to pay the extra money for Sector 38, since the plot owner deposited the money before filing a suit; HUDA is directed to refund the amount, if there is no extra acquisition cost in Sector 38.
The court also quashed the notice issued to the plot owner and directed HUDA to refund the enhancement fees to the petitioner.
In the aftermath of this verdict, HUDA has withdrawn the extra fee notices, providing relief to affected plot owners.
