Homebuyer Shyam Sunder Agrawal booked a flat in Antriksh Golf View, Sector 78, Noida in 2010 with possession due November 2012. Developer offered possession May 2017 without occupancy certificate and necessary documents. RERA Appellate Tribunal directed developer to pay interest from December 2012 to May 2017 at rate one per cent above Marginal Cost of Fund Based Lending Rate. Developer Antriksh Developers and Promoters Pvt Ltd appealed, claiming delay caused by National Green Tribunal order restraining construction within 10-km radius of Okhla Bird Sanctuary. Allahabad High Court rejected appeal. Court noted developer claimed project completed in 2014 and occupancy certificate application made that year, contradicting claim of NGT preventing completion. NGT restriction came August 2013, but contractual deadline was November 2012, so developer's default preceded restriction. Court held benefit of "zero period" extends only to period project actually affected by restraint, not delay before NGT order. Court upheld interest payment direction and dismissed appeal. Accepting delayed possession does not bar statutory right to claim interest, and Real Estate Act prescribes no specific limitation period for such claims.
